Court of Protection

If you have concerns about another person, such as a family member, a friend or neighbour, or anyone who you think is experiencing difficulties in making decisions about their finances and property or their personal welfare, then they may need someone to be appointed to make these decisions on their behalf. An application can be submitted to the Court of Protection that either the Court or a nominated person may make decisions on behalf of someone who may lack the capacity to do so themselves.

If a person does not have an Enduring Power of Attorney nor a Lasting Power of Attorney and if you believe someone lacks the capacity to make that particular decision themselves you will need assistance in assessing their capacity.

If someone becomes mentally unable to manage their financial affairs without having created an Enduring Power of Attorney or Lasting Power of Attorney, the Court of Protection will appoint one on their behalf.

If you are appointed an Attorney, or if you suspect that someone close to you requires the help of the Court of Protection , we can assist.

All Court of Protection cases are unique and different Court powers will apply depending on how substantial the individuals assets are when they become disabled, so each case will need to be discussed in more detail in order to agree the best way forward.
